Memorials of Distinction Conditions of Sale

  1. PLEASE DO NOT SIGN THIS FORM UNLESS YOU WISH TO BE BOUND BY THE CONDITIONS SET OUT BELOW.
  2. Customers are advised to check carefully all details on this form PARTICULARLY WITH REFERENCE TO THE INSCRIPTION, that is the spelling and dates in the inscription. No responsibility can be accepted for errors notified after the signing of this contract. Whilst we take into account instructions received, THE FINAL SETTING OF THE INSCRIPTION AS WELL AS THE LETTERING FONT USED IS ENTIRELY AT THE DISCRETION OF MEMORIALS OF DISTINCTION unless a detailed layout is requested for which a charge is made.
  3. Whilst every effort is made to ensure delivery within a reasonable time no responsibility can be accepted for delay due to weather conditions, non-delivery of materials, labour disputes or other causes beyond the control of Memorials Of Distinction. Subject to the above it is estimated that brochure designs made at standard sizes, in the material and finish shown will take approximately 12 working weeks to manufacture following the receipt of permit and second payment, if required.
  4. Subject to the terms of Hire Purchase Act 1964 (as amended) and to the conditions hereinafter mentioned, this Contract cannot be cancelled by the customer.
  5. If the burial ground or Cemetery Authority refuse permission for the memorial to be erected on grounds which could not be contemplated by the customer when signing the Agreement Memorials of Distinction agree to refund the customer all monies received and neither party shall have any further claim on the other. However should a customer request that an order and subsequent permit application are pursued contrary to advice, Memorials of Distinction reserve the right to retain any deposits should the order be cancelled following the burial grounds rejection of the memorial application.
  6. Prices quoted for any special order, alteration or additional work not included in the catalogue will be confirmed to the customer within 21 days of the order being placed. During this period, the company reserve the right to increase or decrease the price quoted or to reject altogether at their sole discretion.
  7. Where an order is for a memorial which incorporates kerbing, unless otherwise agreed, quotations are applicable only to enclosures not exceeding 6'6" x 2'6" situated on level ground that can be accessed with a landing barrow (see next Clause).
  8. It shall be the customer's responsibility to notify Memorials Of Distinction prior to this Contract being signed if the grave is situated on sloping ground or cannot be accessed by a landing barrow. Memorials of Distinction reserve the right to make an additional charge and/or to vary specifications where additional work and/or variation of the specification is required to adapt the memorial to sloping ground or to otherwise to comply with burial ground regulations. It is also the responsibility of the customer to ensure that the grave is clear in readiness for the memorial fixing unless otherwise stated.
  9. All marble stone and granite included in our specifications are natural quarried materials and as such are subject to natural blemishes, small defects and staining. All such materials are sold subject to these natural blemishes and any stopping or cramping which Memorials of Distinction shall consider necessary. It is guaranteed, however, that any such defects, whether visible to the naked eye or not, will in no way be detrimental to the durability of the materials concerned. All workmanship and masonry are guaranteed against any naturally occurring faults for 30 years, as are cut only letters. Any paints, gold leaf, lead or foreign bodies applied to the lettering or memorial can only be guaranteed for a period that can be reasonably expected given the circumstances and position of the individual memorial. Unless otherwise stated all inscriptions will be of our standard stock font and incised by means of deep sandblasting. 'V' Cut with a chisel or hand drawn inscriptions are available upon request subject to an additional cost.
  10. Burial Ground Fees are not included in the price quoted for materials and installation of the memorial. Any such fee indicated on this order is an estimate only and subject to adjustment up or down when the amount of the fee charged by the Authority is known.
  11. Memorials Of Distinction reserve the right to use photographs of any job supplied for the purposes of advertising and inclusion in brochures as well as the right to place the companies contact details on any such job.
  12. TERMS OF PAYMENT. A minimum deposit of 20% is required with any order. A further payment of 75% of the outstanding balance plus cemetery fees is required when the order is at the company's works for manufacture in due course. Manufacture will not commence until the afore said further payment and permit has been received. The remaining payment shall be made within fourteen days following the completion of work. In the case of any order which is not being fixed by Memorials of Distinction, i.e. customer collects, delivery to a home, business or shipping agents etc; a minimum deposit of 75% shall be payable with order. The remaining balance shall be payable in full prior to collection or delivery. Payment sent by post shall be entirely at the risk of the customer.
  13. CANCELLATION. In the case of a Cash Sale the customer's signature on the form indicates acceptance of all conditions of sale and renders the document a legal contract not subject to cancellation except at the discretion of Memorials Of Distinction on payment by the customer of adequate compensation. If default is made by the customer in paying a deposit or an instalment for more than 21 days, the Company reserves the right to cancel this contract so retaining any monies received.
  14. Any dispute regarding payment for goods must be received by Memorials Of Distinction in writing within 21 days of invoice.
  15. REMOVAL OF MEMORIALS. With regard to clause 14. If a written dispute of full and final payment is not received within this period. Memorials of Distinction reserves the right to remove, all or part of, any memorial and place it in safe storage. When and only when the final payment, plus a re-fixing fee of £400.00 has been received the memorial shall be re-fixed in the burial ground, as ordered.
  16. REVISION OF PRICE. Orders are accepted at current prices. Where delays are caused unduly by customers not complying with a reasonable request for information or payment of deposits, Memorials of Distinction reserve the right to complete the Contract at prices contained in the current price list.
  17. In some Burial Grounds, graves are not marked by the Authority and no attendants are available to show our masons to the plot and therefore customers are requested to place a clear marker on the grave and provide a clear sketch or map indicating the location.
  18. PHOTOPLAQUES. The excellence or otherwise of the photo-plaque depends entirely on the clarity and size of the photograph supplied by the customer. Therefore, no responsibility whatsoever can be accepted for the resulting quality of the reproduction. Memorials of Distinction reserves the right to remove the background of a photograph where it is felt appropriate. The safe return of customer's photographs cannot be guaranteed due to the nature of the reproduction process. It is ONLY on these terms that we can accept such instructions.
  19. Unless otherwise specifically stated all embellishments on polished granite memorials are obtained by etching into the surface and not by relief carving.
  20. To comply with Burial Ground Regulations it may be necessary to vary the specification. Any alterations that may be required will be illustrated on the Burial Grounds application form but in any case will not be below the printed specification.
  21. Title of goods does not pass from Memorials Of Distinction until full and final settlement of the account has been made.
